1. Merchant identity

Laboratoire Larima ltée ("Larima", "we", "us") is the exclusive Canadian distributor of Akileine products made by Laboratoires Asepta in Monaco.

2. Scope

These terms govern every order placed on the Site by a consumer. By placing an order, you confirm that you have read and accepted these terms as well as our shipping, returns and refund, and privacy policies, which form an integral part of them. They in no way limit the rights granted to you by Quebec's Consumer Protection Act (the "CPA") or any other law of public order.

You must have reached the age of majority in your province or territory of residence to place an order.

3. Products

The products sold on the Site are cosmetics intended for external use. They are described as accurately as possible; photographs are for illustration purposes and the appearance of packaging may vary slightly. Always read the label and directions before use, follow the precautions indicated and stop using the product if a reaction occurs. The advice published on the Site is general in nature and does not replace the opinion of a doctor, podiatrist or other health professional.

We reserve the right to limit quantities per order, to withdraw a product from the catalogue and to refuse an order that appears intended for resale.

4. Prices and taxes

Prices are shown in Canadian dollars (CAD).

Applicable sales taxes (GST and QST for delivery in Quebec; GST or HST depending on the province or territory of delivery) are calculated and shown in the cart before you confirm your order. Shipping costs are shown separately in the cart and in the order summary. In accordance with section 54.4 of the CPA, the total price of your order, including taxes and shipping costs, is presented to you before you confirm it.

For delivery to the United States, the prices shown include applicable customs duties and taxes; no additional amount is collected on delivery.

In the event of an obvious pricing error, we will inform you before shipping and you may confirm the order at the correct price or cancel it at no charge.

5. Ordering and formation of the contract

Ordering takes place in clearly identified steps: product selection, entry of your contact details and shipping address, choice of delivery method, payment, then a complete summary that lets you check and correct any error before confirming.

The contract is formed when you click the payment confirmation button. We send you immediately, and no later than fifteen (15) days after the contract is formed, a confirmation email containing all the information required by the CPA (products, prices, taxes, charges, delivery method and time, our contact details and our policies). Keep this email: it is your copy of the contract.

6. Payment

Payment is made online, at the time of ordering, by credit card (Visa, Mastercard, American Express) or by one of the accelerated checkouts offered at payment (Shop Pay, Apple Pay, Google Pay). Transactions are processed by PCI-DSS certified providers; we never have access to your card details. The amount is charged when the order is confirmed.

7. Delivery

Delivery terms, times and costs are detailed in our shipping policy. The delivery date or time frame is indicated to you before you confirm your order. If the product is not delivered within thirty (30) days of the date indicated (or, if no date is indicated, of the formation of the contract), you may cancel the order under section 54.9 of the CPA and receive a full refund within fifteen (15) days.

8. Cancellation and chargeback

In addition to the cases covered in section 7, you may cancel the contract within the time limits and under the conditions set out in sections 54.8 and following of the CPA, notably if we have not met our disclosure obligations before or after the contract was formed. Cancellation is made by written notice to info@akileine.ca. We refund you within fifteen (15) days of cancellation; failing that, you may request a chargeback from your credit card issuer within sixty (60) days after that deadline (section 54.14 of the CPA).

9. Returns and refunds

The conditions for voluntary returns and refunds (30 days, unopened product) are described in our returns and refund policy. They are in addition to the remedies provided by law and do not replace them.

10. Warranties

In accordance with sections 37 and 38 of the CPA, the products sold must be fit for the purpose for which they are normally intended and be of reasonable durability, having regard to their price and the conditions of the contract. They must also conform to their description on the Site and in advertising (sections 40 and 41). These legal warranties apply by operation of law and cannot be excluded.

The products are manufactured by Laboratoires Asepta in accordance with the standards applicable to cosmetics and are notified to Health Canada. The minimum durability date or the period-after-opening symbol appears on the packaging where regulations require it.

11. Liability

We are responsible for performing the obligations arising from the distance contract, within the limits provided by law. Nothing in these terms excludes or limits our liability in a manner contrary to the CPA or the Civil Code of Québec. We cannot be held responsible for use of the products that does not comply with the directions or precautions on the packaging.

12. Use of the Site

You agree to use the Site for lawful and personal purposes, to provide accurate information and not to interfere with its operation or security. We reserve the right to suspend access to the Site for anyone who breaches these terms.

Reviews, comments or photographs you send us may be published on the Site after moderation; you confirm that you hold the rights to them and grant us a non-exclusive licence to reproduce them. We may remove any content that is inaccurate, misleading or inappropriate.

13. Intellectual property

The Site and its content (text, photographs, illustrations, logos, videos) are protected by copyright and belong to Laboratoire Larima ltée or its licensors. Akileine, Sports Akileine, Cicaleïne, Onykoleïne, Akildia, Akil Toilette and Akilhiver are trademarks of Laboratoires Asepta (Monaco), used under licence. Any reproduction or use without written authorization is prohibited.

14. Personal information

The collection and use of your personal information are governed by our privacy policy.

15. Language

These terms are drawn up in French, in accordance with the Charter of the French Language. An English version is provided for the convenience of our customers; in the event of a discrepancy, the French version prevails, unless you have expressly chosen to contract in English.

16. Governing law and dispute resolution

These terms and any contract formed on the Site are governed by the laws in force in Quebec and the laws of Canada applicable therein. Any dispute will be submitted to the competent courts of the judicial district of our head office, subject to the provisions of the CPA that allow you to bring an action in the district where you reside.

17. Changes

We may change these terms at any time. The version that applies to an order is the one in force when the order is confirmed; the current, dated version is always available on the Site.
